These Terms of Service ("Terms") govern your access to and use of the website at play.partyanimaltoys.com (the "Site") and all related services, features, and content (collectively, the "Services") operated by Party Animal, LLC ("Party Animal," "we," "us," or "our"), a company based in Westlake, Ohio, USA.

By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Site or Services.

1. Eligibility

The Services are intended for users who are 13 years of age or older. By creating an account, you represent and warrant that you are at least 13 years old. Users under 13 are not permitted to create accounts or use the Services. We reserve the right to terminate accounts that we reasonably believe belong to users under 13. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Account Registration

• You must provide a valid email address and create a password to register for an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• You may not create more than one account per person. Duplicate or fraudulent accounts may be terminated at our discretion.

3. User Content

3.1 Avatar Customization

The Services allow you to customize digital avatars using assets and options provided by Party Animal ("Avatar Assets"). All Avatar Assets — including character designs, body types, hairstyles, uniforms, accessories, and related artwork — are and remain the exclusive property of Party Animal, LLC.

3.2 Player Names

You may assign a player name to your avatar. Player names must not be offensive, vulgar, discriminatory, or infringe on the rights of any third party. We reserve the right to remove or modify player names that violate these Terms at our sole discretion, without prior notice.

3.3 License to Your Content

By creating and saving an avatar, selecting a player name, or participating in the Services, you grant Party Animal a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your avatar configuration and player name in connection with the Services, including on shared avatar pages, in promotional materials, and in connection with contests.

3.4 No Ownership Transfer

Your use of Avatar Assets does not transfer any ownership or intellectual property rights to you. You receive a limited, non-exclusive, non-transferable, revocable license to use Avatar Assets solely within the Services for personal, non-commercial use.

4. Sharing and Public Pages

When you activate your avatar and share it, a public page is generated that displays your avatar, player name, and username. This page is accessible to anyone with the link. By sharing your avatar, you acknowledge and consent to this public visibility.

Shared links include a unique referral token for contest bonus entry tracking. You may not manipulate, automate, or fraudulently generate share confirmations. Automated or fraudulent sharing activity may result in disqualification from contests and account termination.

5. Contests and Sweepstakes

5.1 No Purchase Necessary

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN ANY CONTEST OR SWEEPSTAKES OFFERED BY PARTY ANIMAL, LLC. A purchase will not improve your chances of winning.

5.2 Eligibility

Contests are open to legal residents of the United States who are 13 years of age or older at the time of entry. Employees of Party Animal, LLC, its affiliates, and their immediate family members are not eligible. Void where prohibited by law.

5.3 Methods of Entry

Online Entry (no purchase necessary): You may receive one (1) contest entry by creating a free account on the Site and activating your avatar (selecting a scene). You may receive additional bonus entries by sharing your avatar link and having another person open it. Entry limits and bonus entry mechanics are described on the Contest page and may change from time to time.

Optional Bonus Entry for Marketing Consent: One (1) bonus entry per contest is available to entrants who choose to receive our marketing emails. Consent is entirely optional: it is never required to enter, to receive your base entry, or to win, and withdrawing it later does not remove entries you have already earned. Entrants who decline may earn an equivalent bonus entry through any other bonus action listed on the Contest page, none of which require marketing consent. Mail-In Entry (no purchase necessary): To enter without creating an account, hand-print your full name, mailing address, email address, and date of birth (to verify eligibility) on a 3" x 5" card and mail it in a #10 envelope with proper postage to:

Mail-in entries must be postmarked by the contest end date and received within seven (7) business days of the contest closing to be eligible. Limit one (1) mail-in entry per person per contest. Illegible, incomplete, or mechanically reproduced entries will not be accepted. Party Animal, LLC is not responsible for lost, late, misdirected, damaged, or postage-due mail. Each valid mail-in entry will receive the same number of entries as one (1) online entry.

5.4 Winner Selection and Prizes

Winners are selected at random from all eligible entries (both online and mail-in) after the contest period ends. Winners will be notified by email (or by mail for mail-in entrants who did not provide an email address). Prizes are non-transferable and have no cash value. Party Animal reserves the right to substitute prizes of equal or greater value. Failure to respond to winner notification within 14 days will result in forfeiture and selection of an alternate winner. Odds of winning depend on the total number of eligible entries received.

5.5 Modifications

Party Animal reserves the right to modify, suspend, or cancel any contest at any time for any reason, including but not limited to fraud, technical failures, or any other factor that impairs the integrity of the contest.

6. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Create accounts using false or misleading information.
• Use automated scripts, bots, or other means to access the Services, create accounts, submit entries, or generate share confirmations.
• Attempt to gain unauthorized access to other users' accounts or any part of the Site or Services.
• Interfere with, disrupt, or place an unreasonable burden on the Site or its infrastructure.
• Use player names or usernames that are offensive, vulgar, threatening, harassing, defamatory, or that infringe on the intellectual property rights of any third party.
• Reproduce, modify, distribute, or create derivative works from Avatar Assets outside of the Services without our express written permission.
• Use the Services commercially or for promotional purposes without our prior written consent.

7. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, character designs, avatar assets, images, software, and the overall look and feel of the Site — is the property of Party Animal, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Party Animal," "TeenyMates," "SqueezyMates," and related logos and character names are trademarks of Party Animal, LLC. You may not use these marks without our prior written permission.

8. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may delete your account at any time by contacting us. Upon account deletion, all associated data will be permanently removed.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARTY ANIMAL, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Party Animal, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through the Site. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and Children's Privacy Policy, constitute the entire agreement between you and Party Animal, LLC regarding the use of the Site and Services and supersede all prior agreements and understandings.
